Contributors who wish to submit their travel newsletters for inclusion in our Service must adhere to our submission guidelines. Each newsletter must be the original work of the Contributor or they must have explicit permission to distribute the content. Contributors retain ownership of their newsletters but grant TravelLetters.com a worldwide, perpetual, irrevocable, royalty-free license to publish, distribute, and promote the newsletters as part of our Service. We reserve the right to reject any newsletter submission at our discretion and without providing reasons.

  1. Third-Party Links and Content

The Service may contain links to third-party websites or services that are not owned or controlled by TravelLetters.com. We provide access to these links as a convenience to you, and the inclusion of any link does not imply endorsement, approval, or recommendation by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that TravelLetters.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

  1. Limitation of Liability

To the fullest extent permitted by applicable law, TravelLetters.com, its affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.

You agree to defend, indemnify, and hold harmless TravelLetters.com, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service’s content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Service.

  1. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the jurisdiction where TravelLetters.com is operating from, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

  1. Dispute Resolution

Before filing any claim against TravelLetters.com, you agree to attempt to resolve the dispute informally by contacting us. We’ll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 15 days of submission, you or TravelLetters.com may bring a formal proceeding. You and TravelLetters.com agree to resolve any claims relating to these Terms or the Service through final and binding arbitration by a single arbitrator, except as set forth under Exceptions to Agreement to Arbitrate below.

  1. Severability

If any provision of these Terms is held to be invalid or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
